TALIBON CYCLING ADVENTURES (TALCYCAD), INC.

WAIVER AND RELEASE FROM LIABILITY

KNOW ALL MEN BY THESE PRESENT:

I, _______________________________________________, of legal age, single/married, Filipino and a resident of ____________________________________________________,

WITNESSETH:

1. That I desire and intend to participate in the race dubbed as “TALCYCAD Race” sponsored by Talibon Cycling for Adventures, Inc. on August 14, 2010;
2. That I have read and understand the rules of the particular event which I will participate and shall abide with the rules and regulations of the said race and/or its sanctioned races and shall undertake extensive practice and training on the route/course to be used for the said race, or elsewhere;
3. That I have surveyed and acquainted myself with the venue of the race and have found the safe devices for the protection and welfare of the participants therein to my complete satisfaction. I also acknowledge and declare that I will not rely upon said safeguard but also upon my own skill and sound judgment while on within said route, racetrack or premises thereof;
4. That I am fully conscious of the dangers and perils involved during the period of training, elimination and final races, sponsored and sanctioned by the race organizers and thereby solely, fully and exclusively assumed all risk, hazards, liabilities and responsibilities for the injury sustained, damaged inflicted or death caused to me or any other property/or by me to third persons or properties due to or caused by defect, fault in, or condition or the race track, roads, highways, bridges, equipment thereon, including signal lights, flags and other traffic devices. I also assume the risks, hazards, liabilities and responsibilities for any loss or damage caused by me to vehicles and injury or death to pedestrians/persons watching said practice, elimination, final races and other events.;
5. That as condition for my entry and participation therein, and in consideration of the trophies and/or prizes to be awarded to the winners and the participants by the sponsors and race organizers, I hereby bind myself to respect and abide in their decision for such benefits I may derive, therefrom. I also freely discharge and render free, and clear the race organizers, its benefactors, successors and authorized representatives and the owners and/or operators of the race track, including any and all other persons, firms, entities and government institutions, who or which has anything or something to do, or connected with, or in anyway related to, simply present, at the conduct or holding the said practice, qualifying eliminations and final races, from any and all responsibilities, liabilities, claims demands, or any and all other any causes of action of whatever kind and nature arising from, by reason of any losses, damages, injuries or death suffered by me during or resulting from or as consequences of participation;
6. Further, I freely, completely, voluntarily and perpetually waive and relinquish any and all rights which I now or may hereafter have thereunder and I agree and declare that no other agreement, contract or commitment, either verbally or in writing, shall in any manner affect, alter or modify this absolute and complete waiver and release;
7. And finally, for and in consideration of the rights and privileges extended to me by the race organizers, I bind myself, my successors to grant, as I hereby grant the race organizers the right and privilege to use my name, photographs, portraits, and person in connection with publicity, advertising and promotion of the bike race and other projects of the race organizers;
8. That I execute this instrument and subscribe my name hereunder freely and voluntarily, fully aware of all the consequences and implications thereof.
